Marijuana shop owner's drug record may jeopardize dispensary

LANSING, MI –

The owner of a controversial medical marijuana dispensary in Lansing says his business is unfairly threatened by a provision in the city's pending medical marijuana ordinance.

Earlier this week, city officials revealed the first draft of a measure to regulate medical marijuana in the city. Among other provisions, it calls for criminal background checks for the operators of marijuana dispensaries.

Danny Trevino owns a dispensary in Old Town. He was convicted of a cocaine felony in the early 90's and a marijuana felony about 8 years ago. He says the city ordinance would put him out of business. Trevino claims the state statute doesn't address the issue of criminal background checks and he thinks the city could be over-reaching its authority.

Lansing city attorney Brig Smith declined comment pending discussions with Trevino's attorney.

Legal experts say basic questions on the legality of dispensaries remain unanswered.
